Terms and Conditions

Welcome to KidsHealth360 — a digital platform that supports schools, school administrators and parents/guardians with student health record keeping, wellness suggestions, and assistance with applicable government health and wellness compliance requirements. By accessing or using KidsHealth360.com, any associated mobile application, or related services (the “Services”), you agree to be bound by these Terms. If you do not agree, please do not access or use the Services.

1.Nature and Scope of the Services

KidsHealth360 provides a technology platform for the following limited purposes only:

  • Digital storage, organization, and maintenance of student health-related records submitted by schools, parents, guardians, or authorized healthcare partners.
  • Generation of general, non-clinical wellness suggestions and reminders based on the information recorded on the Platform.
  • Administrative support to help school administrations track and document compliance with applicable government health and wellness mandates and frameworks (including, without limitation, health card/record requirements issued by education boards, school health screening programs, and applicable disability, data protection, and child welfare regulations in force from time to time).
KidsHealth360 is a record-keeping, suggestion, and compliance-support tool only. KidsHealth360 is NOT a hospital, clinic, diagnostic centre, telemedicine provider, or healthcare practitioner, and does not provide, dispense, supervise, or guarantee any form of medical treatment, diagnosis, prescription, therapy, or clinical care.

2.No Medical Treatment or Clinical Advice

You expressly acknowledge and agree that:

  • KidsHealth360 does not employ, and does not hold itself out as employing, licensed physicians, nurses, or clinicians to diagnose, treat, cure, or prevent any disease or medical condition through the Platform.
  • Any wellness suggestions, reminders, health summaries, or compliance-related outputs generated by or through the Platform are informational and administrative in nature only, and do not constitute medical advice, a medical opinion, or a substitute for consultation with a qualified, licensed healthcare professional.
  • All decisions relating to a child's health, medical treatment, medication, therapy, vaccination, or emergency care must be made in consultation with a qualified doctor or appropriate healthcare provider, and not on the basis of information displayed on or generated by the Platform.
  • In case of a medical emergency, Users must contact a licensed physician, hospital, or local emergency services immediately. KidsHealth360 is not designed or intended for use in emergencies.

3.Compliance Support — Nature of Assistance

Where the Platform provides features, templates, checklists, or documentation intended to help a School Administration track or demonstrate compliance with government health, wellness, disability, or data protection requirements:

  • Such features are provided as administrative and informational aids only, based on publicly available regulatory frameworks as understood at the time of development.
  • KidsHealth360 does not guarantee that use of the Platform will result in full, continuing, or correct legal or regulatory compliance by any School or Administrator.
  • Applicable laws, government circulars, and board mandates may change from time to time, and it remains the sole responsibility of the School/Administrator to verify current requirements with the relevant statutory or regulatory authority and, where appropriate, with independent legal counsel.
  • KidsHealth360 is not a government body, regulator, or certifying authority, and use of the Platform does not constitute or guarantee any government approval, accreditation, or certification.

4.Eligibility and Accounts

  • The Services are intended for use by schools, school administrators, and parents/guardians of enrolled students. Individuals under 18 years of age may only be represented on the Platform through a parent, guardian, or authorized school administrator.
  • Users are responsible for maintaining the confidentiality of login credentials and for all activity that occurs under their account.
  • Users agree to provide accurate, current, and complete information when creating student health records and to promptly update such information where it changes.

5.User Responsibilities

  • Schools and Administrators are responsible for obtaining any consents required from parents/guardians before uploading or processing a student's health information on the Platform.
  • Users shall not use the Platform for any unlawful purpose, to submit false or misleading health information, or to access records of students/individuals they are not authorized to access.
  • Users shall not attempt to reverse-engineer, disrupt, or gain unauthorized access to the Platform, its data, or its infrastructure.

6.Intellectual Property

All content, software, design elements, trademarks, and materials on the Platform (excluding User-submitted data) are the property of KidsHealth360 or its licensors and are protected by applicable intellectual property laws. No right, title, or interest in such material is transferred to Users except a limited, non-exclusive, non-transferable right to use the Services in accordance with these Terms.

7.Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, non-infringement, or that the Services will be uninterrupted, timely, secure, or error-free.

  • KidsHealth360 does not warrant the clinical accuracy, completeness, or currency of any health information, third-party content, or suggestion displayed on the Platform.
  • KidsHealth360 does not warrant that the Platform will meet every School's specific statutory or regulatory obligations.

8.Limitation of Liability

To the maximum extent permitted by applicable law:

  • KidsHealth360, its directors, officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of life, personal injury, medical complications, loss of data, loss of business, loss of reputation, or regulatory penalties, arising out of or in connection with the use of, or inability to use, the Services.
  • KidsHealth360 shall have no liability whatsoever for any medical outcome, treatment decision, diagnosis, delay in treatment, or health consequence experienced by any student or individual, whether or not related to information recorded, displayed, or suggested through the Platform.
  • KidsHealth360 shall have no liability for any regulatory finding, penalty, show-cause notice, or non-compliance determination issued against a School by any government or statutory authority.
  • In no event shall the aggregate liability of KidsHealth360 arising out of or relating to these Terms or the Services exceed the total subscription/service fees actually paid by the User to KidsHealth360 in the twelve (12) months immediately preceding the event giving rise to the claim, or INR 5,000, whichever is lower.

9.Indemnification

Users agree to indemnify, defend, and hold harmless KidsHealth360 and its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) the User's breach of these Terms; (b) inaccurate or unauthorized information submitted by the User; (c) the User's violation of any applicable law; or (d) any medical, treatment, or clinical decision made by the User or a third party in reliance on information from the Platform.

10.Third-Party Services and Links

The Platform may reference, link to, or integrate with third-party services (e.g., hospitals, diagnostic partners, payment gateways). KidsHealth360 does not control and is not responsible for the content, accuracy, or practices of such third parties, and any dealings with them are solely between the User and that third party.

11.Suspension and Termination

KidsHealth360 may suspend or terminate access to the Services, in whole or in part, at its discretion, including for breach of these Terms, non-payment of applicable fees, misuse of the Platform, or as required by law. Schools/Users may discontinue use of the Services at any time, subject to the Refund Policy.

12.Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to applicable law, the courts at Mohali, Punjab shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms.

13.Changes to These Terms

KidsHealth360 may revise these Terms from time to time. Material changes will be notified through the Platform or via registered email/contact details on file. Continued use of the Services after such changes constitutes acceptance of the revised Terms.
